Decoding the City of South Lake Tahoe Short-Term Rental Laws

March 14, 2024 by Michelle Keck

Are you interested in owning rental properties in South Lake Tahoe? Navigating the short-term rental (STR) laws can be challenging. These laws have changed significantly in recent years due to the growing popularity of short-term rentals in the area. This post will explore the basics of South Lake Tahoe short-term rental laws.

Lake Tahoe Real Estate Market Watch

Understanding South Lake Tahoe Short-Term Rental Laws

Measure T is the core of South Lake Tahoe’s STR regulations. The city introduced it in response to growing concerns about the impact of short-term rentals on South Lake Tahoe’s neighborhoods.

Read on to learn the key elements of Measure T.

Geographic Scope

Measure T prohibits vacation rentals outside of the city’s tourist core. It means the city bans short-term rentals within the limits of South Lake Tahoe, except for specific areas like the tourist core.

Phasing Out Existing Permits

Measure T gradually eliminated VHR permits in residential areas and multi-family properties in South Lake Tahoe. This process lasted for three years and ended on December 31, 2021. Since December 2018, the city has granted no new permits for VHRs in residential areas.

Exceptions and Exemptions

  • Tourist Core Area: While Measure T restricts STRs in residential zones, the Tourist Core Area remains exempt. This area, characterized by its commercial and tourism-focused zoning, permits vacation rentals. However, it’s essential to note that properties in this zone may be limited. You can view the City of South Lake Tahoe Zoning Map to confirm whether your property is in a non-residential area.
  • Primary Residence Exemption: Measure T allows for a primary residence exemption. Qualified homeowners can rent out their entire home for up to 30 days per year, whether consecutively or non-consecutively. The homeowner must be a permanent resident. They must also be able to provide proof of a primary residence property tax exemption to qualify. Here’s how you can apply for a permit.

Frequently Asked Questions

  • What are the penalties for violating STR laws in South Lake Tahoe?

South Lake Tahoe strictly enforces its Vacation Home Rental (VHR) Ordinances. Violators—both the guest and the homeowner—may face a penalty of at least $1,000 per violation. Here’s how you can avoid a fine.

  • Can I rent out a room or a portion of my home?

Yes, the hosted rental ordinance in November 2020 introduced regulations allowing qualified homeowners to rent a portion of their homes. However, it’s important to note that hosted rentals are not allowed in multi-family units. The ‘host’ must also reside in the same dwelling unit as the hosted rental.

  • Can I rent out an Accessory Dwelling Unit (ADU)?

Accessory Dwelling Units (ADUs) in South Lake Tahoe are not eligible for short-term/vacation rentals. The purpose of ADUs is to provide housing options for long-term tenants or visiting family members and friends.

Are you ready to navigate South Lake Tahoe’s STR regulations?

Navigating South Lake Tahoe’s STR regulations requires a thorough understanding of Measure T and its implications. Stay informed about updates and changes to ensure compliance and make informed decisions regarding your rental property.
